Terms and Conditions

These Terms and Conditions (“Terms”) govern all services provided by Fizzsite.com (“Fizzsite,” “we,” “us,” or “our”) to any individual or business (“Client,” “you,” or “your”) that purchases a website design, hosting, or maintenance service from us. By placing an order, signing a proposal, or making payment, you agree to be bound by these Terms.

1. Our Services

Fizzsite offers two primary service tiers, described below. Each tier is a distinct service with its own scope, pricing, and terms. Purchasing one tier does not entitle the Client to the pricing, features, or terms of the other tier unless explicitly stated in writing.

1.1 Starter Plan

The Starter Plan is a subscription-based website service in which the Client selects a website design from Fizzsite’s library of pre-built templates. Fizzsite customizes the selected template with the Client’s business name, brand colors, photos, and text. The Starter Plan includes website hosting, ongoing updates (subject to Section 3 below), and priority customer support, billed monthly with no long-term contract required.

1.2 Custom Build

The Custom Build service is a one-time, fully original website design built specifically around the Client’s business, goals, and brand — not based on a template. Custom Build includes a discovery consultation, original design and layout, and delivery of a completed website. Hosting and ongoing maintenance are not included in the Custom Build price and are offered separately (see Section 1.3).

1.3 Optional Hosting & Maintenance for Custom Build Clients

Custom Build clients may optionally subscribe to the Starter Plan's hosting and maintenance service at the standard published monthly rate to host and maintain their completed custom website. As a thank-you for choosing a Custom Build, new Custom Build clients receive their first month of hosting and maintenance at no charge if they subscribe within 30 days of website delivery. After the first month, the standard monthly rate applies with no further discount, as hosting and maintenance is a separate, ongoing service distinct from the one-time design fee already paid.

2. Pricing and Payment

Starter Plan: billed monthly in advance. No long-term contract. Cancel anytime; no refunds are issued for partial months.
Custom Build: priced per project starting at $1,500, based on scope, page count, and complexity, as quoted in writing prior to the start of work.
Custom Build projects require a non-refundable deposit of 50% of the total project price before design work begins. The remaining balance is due upon completion, before the website is published live or final files are delivered.
All prices are listed in U.S. Dollars and are subject to change with notice. Price changes do not apply retroactively to active subscriptions until the Client's next renewal term.

3. Scope of “Unlimited” Updates (Starter Plan)

The Starter Plan includes “unlimited updates,” meaning the Client may request reasonable ongoing changes to text, photos, and minor layout elements on their website without per-request fees, subject to the following conditions:

“Unlimited” refers to the number of update requests submitted over time, not the frequency or turnaround speed of those requests. Fizzsite does not guarantee same-day or instant turnaround on any update request under the Starter Plan.
Standard update requests are limited to a reasonable volume consistent with normal small business use — generally up to a few requests per week. Businesses requiring daily updates, multiple updates per day, or real-time changes (such as daily price changes, daily inventory updates, or frequently changing menus/specials) fall outside the scope of “unlimited” updates under the Starter Plan and require a separate High-Frequency Update add-on, priced upon request.
Updates covered under the Starter Plan include: text edits, photo swaps, minor styling adjustments, and similar content-level changes that do not require new page creation, custom design work, new functionality, or structural changes to the website.
Not covered under “unlimited” updates: building new pages, custom programming or integrations, e-commerce setup, redesign of existing sections, or any work Fizzsite determines, in its reasonable judgment, falls outside routine content maintenance. Such work will be quoted separately.
Fizzsite reserves the right to classify a Client's update pattern as exceeding reasonable use and to notify the Client that a High-Frequency Update add-on or a different service tier is required going forward.

4. Custom Build Ownership

Upon receipt of full and final payment, the Client owns the completed Custom Build website, including its unique design and code, for their own use. Stock photography, licensed fonts, third-party plugins, and similar third-party assets remain subject to their own respective licenses and are not owned by the Client. Fizzsite retains the right to display completed work in its portfolio unless the Client requests otherwise in writing.

5. Cancellation and Refunds

Starter Plan subscriptions may be cancelled at any time. Upon cancellation, hosting will be discontinued and the website will no longer be accessible online unless the Client arranges alternative hosting and requests a transfer of files (see Section 6).
Custom Build deposits are non-refundable once design work has begun, as they secure scheduling and compensate for time and resources committed to the project.
If the Client cancels a Custom Build project before any work has begun, the deposit will be refunded in full, less any payment processing fees already incurred.

6. Website Transfers and Data

If a Client cancels Starter Plan hosting or chooses not to renew, Fizzsite will provide a copy of the Client's website files and content upon written request, provided the account is in good standing with no outstanding balance. Fizzsite is not obligated to retain website files or backups indefinitely after cancellation and recommends Clients request a transfer promptly.

7. Client Responsibilities

Clients must provide accurate business information, content, and timely feedback needed to complete design and update requests.
Clients are responsible for the legality of all content, images, and claims published on their website, including compliance with applicable advertising, industry, and accessibility regulations relevant to their business.
Clients must not use Fizzsite-hosted websites for unlawful purposes, including but not limited to fraud, harassment, or distribution of malicious content.

8. Limitation of Liability

Fizzsite strives to deliver reliable, high-quality websites and services, but does not guarantee specific business outcomes, search engine rankings, or revenue results from any website we build or host. To the maximum extent permitted by law, Fizzsite's total liability for any claim arising from our services is limited to the amount paid by the Client for the specific service giving rise to the claim. Fizzsite is not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities.

9. Changes to These Terms

Fizzsite may update these Terms from time to time. Material changes will be communicated to active Clients by email. Continued use of Fizzsite's services after such notice constitutes acceptance of the updated Terms.
